DESCRIPTION:Stefan Schnurr:\nHow do children and parents experience child protection proceedings?\nStefan Schnurr is Professor and Head of the Institute for Studies in Children and Youth Services at the University of Applies Sciences and Arts Northwestern Switzerland. His research interests include social work\, child- and youth services\, international social work and social policy\, and participation. Schnurr has both led and been a part of several research projects which aimed to add to the knowledge on and further the development of child and youth services in Switzerland. DESCRIPTION:Jonathan Jackson:\nLegitimacy: a psychology and law perspective\nJonathan Jackson is Professor of Research Methodology and Head of the Department of Methodology at The London School of Economics and Political Science. He is an Honorary Professor of Criminology at the University of Sydney Law School and an Affiliated Scholar in the Justice Collaboratory of Yale Law School. Working at the intersection of psychology and law\, his research focuses on procedural justice\, distributive justice and legitimacy in the context of the criminal justice system. He has led several high-profile projects into public trust and institutional legitimacy in the field of criminal justice\, most of which have been funded by the Economic and Social Research Council (ESRC) and the European Commission’s FP7 programme. He is currently working on an ESRC-funded project (with Clifford Stott at Keeleand Ben Bradford at UCL) that aims to systematically test and advance theoretical understanding of some core causal claims of procedural justice theory. DESCRIPTION:Katrin Križ & Mimi Petersen:\nChildren’s participation in child protection: International research and practical applications\nKatrin Križ is Professor of Sociology at Emmanuel College in Boston\, and research associate at the DIPA Centre\, as well as research affiliate at the Center on Law and Social Transformation. In her research she has compared child welfare systems in an international context and studied migrant education and poverty alleviation policy in the United States. Her most recent research focuses on the role of professional discretion in decisions related to a child’s best interests in several EU countries. Križ has written a number of articles on child right issues and welfare\, and contributed to the new book by Pösö\, Skivenes & Thoburn (2021) on the topic of adoption from care in an international perspective. DESCRIPTION:Hvordan opplever barn og foreldre barneverssaker? En av kjernefunksjonene i ethvert barnevernsystem er å beskytte og gjenreise barns integritet. For å utøve denne funksjonen er det avgjørende at profesjonelle i barnevernstjenesten har tilstrekkelig med kunnskap om hvordan barn og foreldre opplever barnevernssaker. Mangelfull innsikt i hvordan barn og foreldre erfarer barnevernssaker kan potensielt sett skade barns integritet og forhindre barns medvirkning – i strid med saksbehandlers intensjoner. I denne utgaven av Barnevernfrokost vil Professor Stefan Schnurr ta utgangspunkt i det sveitsiske barnevernet og et pågående forskningsprosjekt som studerer barns og foreldres erfaringer med barnevernet for å belyse hvilke forhold som best tilrettelegger for barns medvirkning og samtidig ivaretar deres selvstendighet og beskytter deres integritet. DESCRIPTION:Kvalitet i intervju er avgjørende for at barn som er utsatt for omsorgssvikt\, eller potensielt vold og overgrep\, får anledning til å fortelle fritt og upåvirket om det de har opplevd/blitt utsatt for. Imidlertid viser både nasjonal og internasjonal forskning at det er vanskelig å opprettholde kvalitet over tid i intervju av barn til tross for at det investeres store ressurser i opplæring i samtale- og avhørsmetodikk. Hvordan kan kunstig intelligens og interaktive avatarer være nyttige verktøy for ferdighetstrening i barnevernstjenesten og blant politiansatte som skal gjennomføre slike intervjuer? \nGunn Astrid Baugerud er Førsteamanuensis ved Institutt for sosialfag ved OsloMet. DESCRIPTION:Hvordan rettferdiggjøres adopsjon?\nHege Beate Stein Helland disputerer 19.11.2021 for ph.d.-graden ved Universitetet i Bergen med avhandlingen “Discretion and the Demand for Reasons”. \nHvordan rettferdiggjør juridiske og profesjonelle beslutningstakere hva som er til «barnets beste» i beslutninger om adopsjon av fosterbarn? Med fokus på kvalitet og legitimitet i begrunnelser av statlige intervensjoner\, undersøker Helland hvordan norske og engelske beslutningstakere utøver skjønn når de forholder seg til det førende\, men komplekse prinsippet om barnets beste. Skjønnsmessige vurderinger er nødvendig for å komme frem til hva som er til det beste for det enkelte barn\, men utfordrer samtidig demokratisk kontroll over beslutningsprosessen\, og åpner for variasjon i beslutningsfatting. \nStudien viser at barnets beste i stor grad blir rettferdiggjort gjennom barnesentrert argumentasjon. Det er likevel slik at foreldreorienterte begrunnelser er avgjørende for vurderingene om hvorvidt en adopsjon anses å være til barnets beste. Samtidig viser avhandlingen at beslutningstakerne baserer seg på et relativt uniformt og hierarkisk strukturert normativt grunnlag\, og begrunnelsene er rettet mot å rettferdiggjøre unntak for det biologiske prinsipp. Det er også tydelig at Høyesteretts praksis i stor grad er førende for hvilke argumenter som anvendes og vektes. Det omfattende skjønnsrommet beslutningstakerne er gitt sammenfaller imidlertid også med variasjon og inkonsistens\, samt mangler og ubalanse i argumentasjonen. På den andre siden viser analysene tegn til uformelle beslutningsstandarder og regeldannende praksis. DESCRIPTION:Dr. Cathrine Holst: Epistemic worries about expertise and the design of better policy advice: examples from the NOU system\nCathrine Holst is Professor of Sociology at the Department of Sociology and Human Geography\, University of Oslo. Her academic interests include political sociology and democracy research\, social and political theory\, the role of knowledge and expertise in policy and politics\, EU\, and gender policy. Holst is a part of and (co-)leader of several research groups and projects. Likevel vet vi lite om foreldreveiledningen er tilpasset godt nok og hvordan det påvirker foreldreomsorgen for familier med flykning eller annen minoritetsbakgrunn. I introduksjonsprogrammet er foreldreveiledning obligatorisk og ulike veiledningsprogram brukes som tiltak i barnevernet. SUMMARY:Barnevernfrokost: Fra barnets beste til gjenforening som overordnet mål for barnevernstiltak etter omsorgsovertakelse? (Christian Børge Sørensen)
DESCRIPTION:Siden høsten 2018 er Norge hittil dømt i Den europeiske menneskerettighetsdomstol for å ha krenket retten til familieliv i 14 barnevernssaker. Dette har ført til endringer i norsk barnevernsrett og praksis\, ved økte krav til den nasjonale saksbehandlingen. Tema for Sørensens foredrag er det materielle/innholdsmessige; nemlig hvordan det rettslige gjenforeningsmålet i Den europeiske menneskerettighetskonvensjonen har fått langt større betydning for barnevernstiltak etter omsorgovertakelse. DESCRIPTION:Mikael Rask Madsen is the Head of the Centre of Excellence for International Courts (iCourts\, University of Copenhagen) and Professor at the Faculty of Law. He holds a PhD in Sociology of Law from École des Hautes Études en Sciences Sociales in Paris\, and has significant teaching experience from having studied and researched at a number of other leading universities\, including Oxford University\, the University of California at Berkeley\, and the University of Strasbourg. I dette foredraget får vi høre erfaringer og råd fra barn\, presentert av proffer i Forandringsfabrikken. Hvor mye og hvordan samvær skal gjennomføres er viktige avgjørelser for barn. Hva sier kunnskapen fra barn og barns rettigheter om hvordan avgjørelsene kan bli riktigst mulig for barna? DESCRIPTION:Sheila Ramaswamy has a background in Medical and Psychiatric Social Work and Public Health and is Technical and Operational Lead at SAMVAD (Support\, advocacy & mental health interventions for children in vulnerable circumstances and distress) in India. Her technical areas of work over the years\, include maternal and child health\, nutrition and food security\, water and sanitation\, and child and adolescent mental and psychosocial healthcare. DESCRIPTION:Øyvind Stiansen is Associate Professor of Political Science at the University of Oslo. His research interests include judicial politics\, the appointment of judges\, judicial impact\, compliance with judicial decisions\, and applied quantitative methods. He is also interested in the European Court of Human Rights and international courts and tribunals\, and has researched judges’ career incentives and ideology\, and how judge behavior is affected by changes in the political context.
