SUMMARY:RDV:  (Un)Constitutional Educational Indoctrination
DESCRIPTION:This year marks the centennial of Pierce v. Society of Sisters (1925)\, a landmark decision in which the U.S. Supreme Court struck down a compulsory public school education law and established the rights of parents to direct their children’s education. The important question in Pierce’s wake is when compulsory education is unconstitutional state “indoctrination.” This talk asks whether\, one hundred years later\, it is possible that we still do not have an answer. Pierce drew the line at a state compelling public-school attendance. The Court granted states a license to control the subjects all students would be required to study\, for how long\, and at what level. In other words\, the Court allowed states to create and control a statewide curriculum. Only\, it prohibited states from mandating a particular form of education\, even while allowing states to regulate its content. The talk explores the extent to which it can be said that essentially every state law pertaining to the education of children is indoctrinating in some sense. \nAbout the speaker \nZalman Rothschild is Assistant Professor of Law and Horn Family Distinguished Research Scholar in Law and Religion at the Benjamin N. Cardozo School of Law. Professor Rothschild holds a JD\, magna cum laude\, from Harvard Law School and a PhD in Religion from New York University. Previously\, he was a Bigelow Fellow at the University of Chicago Law School\, a law clerk to Judge Jane Roth on the US Court of Appeals for the Third Circuit\, and a litigation associate at Paul\, Weiss. During his time in practice\, Professor Rothschild was recognized by The American Lawyer in its “Litigator of the Week” profile and received the “On the Rise—Top 40 Young Lawyer” award from the American Bar Association. \nProfessor Rothschild’s research focuses on the First Amendment\, anti-discrimination law\, and law and religion. His scholarship has or will appear in Columbia Law Review\, Cornell Law Review\, and Georgetown Law Journal\, among other places\, and has been featured in The New York Times\, The New Yorker\, and the New York Review of Books. His popular writing has appeared in The Atlantic\, the Los Angeles Times\, and the Washington Post. SUMMARY:Barnevernfrokost: Prosesser ved godkjenning og opphør av godkjenning av barneverninstitusjoner. En komparativ nordisk studie
DESCRIPTION:Velkommen til Barnevernfrokost\, fredag 4 april kl. 9:00 med Elisabeth Backe-Hansen.  \nBli med på Barnevernfrokost\, der Dr. Elisabeth Backe-Hansen diskuterer lisensiering av barnevernsinstitusjoner på tvers av nordiske land.  \nPresentasjonen bygger på to artikler om henholdsvis lisensiering (Nordic Welfare Research\, 2022) og tilbaketrening av lisensiering (Child and Family Social Work\, 2024) av barneverninstitusjoner i Danmark\, Finland\, Norge og Sverige.   \nTemaet har vært svært lite utforsket. Hun og forskergruppa hennes var spesielt interessert i å analysere forskjeller og likheter mellom de nordiske landene\, fordi landene ellers har relativt like velferdsordninger på mange måter. Forskergruppa besto av deltakere fra alle fire land\, og de samlet inn data fra hver våre land i to omganger. Analysene i begge artikler bygger på begreper fra teorier om regulering og overvåking\, ut fra at lisensiering er et offentlig instrument som brukes til å kontrollere velferdstjenester.   \nI presentasjonen vil hun utdype funnene\, og samtidig se om det går an å se noen sammenhenger mellom ulikhetene i prosessene knyttet til lisensiering\, prosesser for videre oppfølging og fratakelse av godkjenning.  \nElisabeth Becke-Hansen er psykolog og forsker emerita ved NOVA\, OsloMet. Som forsker har hun hele tiden arbeidet med spørsmål knyttet til barnevern\, med spesielt fokus på beslutningsprosesser ved omsorgsovertakelse\, fosterhjem og institusjoner\, samt problemstillinger knyttet til etikk og forskning med barn og barn og unges medvirkning. Hennes nyeste publikasjoner er som medforfatter på en artikkel om samvær i fosterhjem\, og to kapitler om forskningsetikk i en ny bok om etikk i psykologisk praksis. \nModerator: Mathea Loen \n\nJoin us for the Barnevernfrokost\, on Friday\, 4 April at 9:00 AM\, where Dr. Elisabeth Backe-Hansen will discuss on licensing of child welfare institutions across Nordic countries (in Norwegian). \nThe presentation is based on two articles on licensing (Nordic Welfare Research\, 2022) and the retraining of licensing (Child and Family Social Work\, 2024) of child welfare institutions in Denmark\, Finland\, Norway and Sweden. \nThe topic has been underexplored. Elisabeth and her research group were particularly interested in analyzing differences and similarities between the Nordic countries\, because the countries have relatively similar welfare systems in many ways. The research group consisted of participants from all four countries\, and they collected data from each of the countries in two rounds. The analyses in both articles are based on concepts from theories of regulation and monitoring\, based on the assumption that licensing is a public instrument used to control welfare services. \nIn the presentation\, she will elaborate on the findings\, and at the same time see if it is possible to see any connections between the differences in the processes related to licensing\, processes for further follow-up and withdrawal of approval. \nElisabeth Becke-Hansen is a psychologist and researcher emerita at NOVA\, OsloMet. As a researcher\, she has continuously worked on issues related to child welfare\, focusing on decision-making process in care order\, foster homes and institutions\, as well as issues on ethics and research with children and the participation of children and youth. Tidligere forsøk på å forbedre samtale– og avhørsferdigheter har i stor grad vært basert på tradisjonell undervisningsmetodikk\, med begrenset effekt. Denne presentasjonen introduserer en innovativ AI-basert metode for opplæring i beste praksis-samtaler med barn. Metoden er utviklet for fagpersoner i barnevern\, politi\, skole\, barnehage og helsevesen. AI-plattformen gir brukerne mulighet til å trene samtaleferdigheter i sanntid med en dynamisk avatar og motta individualisert tilbakemelding på sine ferdigheter.  \nGunn Astrid Baugerud er professor i psykologi og barnevern ved Institutt for Sosialfag\, OsloMet. Not only are children often reluctant to share\, but those who speak with them frequently do not follow best-practice guidelines. Previous attempts to improve conversation and interview skills have largely relied on traditional teaching methods\, with limited effect. This presentation introduces an innovative AI-based method for training in best-practice conversations with children. The method is designed for professionals in child welfare\, law enforcement\, schools\, kindergartens\, and healthcare. The AI platform allows users to practice conversation skills in real time with a dynamic avatar and receive individualized feedback on their performance. \nGunn Astrid Baugerud is a professor of psychology and child welfare at the Department of Social Work\, OsloMet. She holds a Ph.D. in cognitive developmental psychology and leads a research group that developed an AI-based avatar for training professionals\, recognized as groundbreaking by the Research Council of Norway in 2020. Baugerud received a Fulbright scholarship for this work\, which she continued at the University of California\, Irvine\, in collaboration with Professor Jodi Quas. SUMMARY:RDV: Navigating Queerphobia and Anti-Gender Narratives in a Politicized World
DESCRIPTION:NEW DATE: 31 Jan\, 12 noon\n\nQueerphobia has become an issue of political contestation across the world. Transnational groups and governments\, including those in Western countries influenced by leaders like Trump\, mobilize against LGBTQ+ rights using rhetoric that claims gender non-conformity would somehow undermine the family and corrupt children. Queer identities and practices are\, therefore\, increasingly subject to (re)criminalisation and political hostility. Queer activists have to develop strategies and adapt to complex political landscapes. How do queer activists maneuver “anti-gender” narratives that seek to erase their existence\, while curtailing their socio-political participation? What strategies do queer activists and allies adopt and to what extent are they successful? \n\nAbout the speakers\n\nAyo Sogunro is a lawyer\, scholar-activist\, and writer known for his unwavering commitment to advancing LGBTIQ+ rights and democratic freedoms across Africa. He has over fifteen years of experience spanning legal practice\, academic research\, and public advocacy. He is currently a Research Scholar at Osgoode Hall Law School\, York University and additionally consults as a social entrepreneur and human rights worker. Sogunro leverages his skills as a lawyer and writer for the benefit of governmental and non-governmental organisations. He is known for his work in social advocacy and for the protection of civil rights and the rights of sexual minorities in Nigeria. Sogunro was listed as one of the “100 Most Influential Nigerians” in 2017. \n\nMatthew Gichohi is a Postdoctoral Researcher at the Chr. Michelsen Insititute\, University of Bergen. Dr. Gichohi is a political scientist focusing on democratization and identity politics with a particular focus on sub-Saharan Africa. Gichohi’s research studies how processes of democratization are affected by social identities and the norms that surround them. For example\, his work considers how ethnic\, and gender identities are created\, practiced and reinforced to affect political participation and representation.  \n\nErwin Navarro is the Managing Director of Skeiv Verden Vest\, an organisation that supports LGBTQIA+ people with minority backgrounds. He is involved in organising Pride Week in Bergen and has good contact with the queer community at the school. He moved to Norway 13 years ago to complete his master’s degree in Tromsø on integration policy for minorities. Navarro moved to Bergen and has been working for Skeiv Verden Vest since 2021.  \n\nLiv Tønnessen is a political scientist researching gender and politics in the Middle East and Northern Africa. She has a PhD in comparative politics from the University of Bergen. Dr. Tønnessen has a track record from the Middle East and Northern Africa with long term stays in Sudan\, Lebanon and Syria. She has specialized in Sudanese politics for two decades. SUMMARY:Health care providers as petty sovereigns? Migration control and access to welfare
DESCRIPTION:In this presentation\, Marry-Anne Karlsen explores ambiguities in the Norwegian state’s response to irregular migration arising from the interaction and tension between welfare policy and entry control. Specifically\, she investigates the role of discretionary decision-making in (re)producing or challenging state borders in the medical encounter. The ethnographic focus brings forth the multiple and dispersed\, as well as negotiated quality\, of the border in everyday practices and situations.  \nAbout the speaker \nMarry-Anne Karlsen holds a PhD in social anthropology from the University of Bergen in 2015 and a major in human geography from the same place in 2006. Karlsen’s professional interests lie at the intersection of migration control and welfare policy\, and in her PhD thesis Precarious Inclusion. I denne presentasjonen vil innlederne fortelle om prosjektet «Barnevern og sosioøkonomisk ulikhet»\, med vekt på hva registerdata kan fortelle oss om sosial ulikhet i barnevernet.  \nFølgende problemstillinger vil bli belyst:  \n\nHvilke mønstre er det mellom barnas sosioøkonomiske tilhørighet og innhold i meldinger som kommer til barnevernet? \nHvordan henger SØS\, innvandrerbakgrunn og familietype sammen med barns sannsynlighet for å bli meldt til barnevernet\, motta hjelpetiltak eller bli plassert utenfor hjemmet? \n\nMary Elizabeth (MB) Hemler er stipendiat ved Institutt for sosialt arbeid\, NTNU. Hun har bodd i Norge siden 2019\, er opprinnelig fra USA og har en mastergrad i sosialt arbeid fra USA\, samt en mastergrad i nevrovitenskap fra NTNU. Hun har også praksiserfaring som sosialarbeider med hjemløse ungdommer i Los Angeles\, hvor hun så hvordan en stor andel barnevernsbarn ble hjemløse da de ble 18 år. Slik ble også en interesse for sosial ulikhet og barnevern vekket.   \nBente Heggem Kojan er professor ved samme sted\, og har en doktorgrad i sosialt arbeid (NTNU) som omhandler sosial klasse og barnevern. Hun har praksiserfaring fra ulike velferdstjenester med utsatte barn og unge og har undervist samt forsket på tematikken barnevern og ulikhet over flere år. Hun ledet forskningsprosjektet «Barnevern og sosioøkonomisk ulikhet»\, som er utgangspunktet for denne barnevernsfrokosten. Hun er også aktiv i det internasjonale forskernettverket CWIN (Child Welfare Inequalities).  \n___________________________________________________________________________ \nJoin us for Barnevernfrokost where Prof. Bente Heggem Kojan and Mary Elizabeth Hemler discuss child welfare and socio-economic inequality.  \nSignificance of social inequality for children and families’ contact with child protection in Norway  \nChildren belonging to families with low socio-economic status (SES) are greatly overrepresented in child welfare systems around the world\, including in Norway. In this presentation\, the presenters will talk about the project “Child welfare and socio-economic inequality”\, with an emphasis on what register data can tell us about social inequality in child welfare.  \nThe following issues will be highlighted:  \n\nWhat patterns are there between the children’s socio-economic affiliation and the content of messages that come to child protection?  \nHow do SES\, immigrant background and family type relate to a child’s likelihood of being reported to child protection\, receiving assistance or being placed outside the home? \n\nMary Elizabeth (MB) Hemler is a research fellow at the Department of Social Work\, NTNU. She has lived in Norway since 2019\, is originally from the USA and has a master’s degree in social work from the USA\, as well as a master’s degree in neuroscience from NTNU. She also has practical experience as a social worker with homeless young people in Los Angeles\, where she saw how a large proportion of child welfare children became homeless when they turned 18. SUMMARY:RDV-Seminar: Desegregation of education – Czech Republic
DESCRIPTION:This lecture will focus on the desegregation of education in the Czech Republic\, particularly with regard to how the Office of the Ombudsman has been involved in addressing this human rights issue. Segregation in education is a complex problem\, which includes the placing of Romani children in special schools and institutions\, but also education in mainstream primary schools with high proportions of Romani children. Both areas are closely related to living in social exclusion and\, consequently\, to segregation in housing. We will focus on the circumstances of the development of segregation in education\, its consequences\, but also possible solutions or examples of good practice. We will introduce the audience to Czech developments from the 1990s to the present.\n\nThe speaker at this event will be Jakub Konečný and Marek Kosík from The Public Defender of Rights (Ombudsman) of the Czech Republic \n\nThe panel will be moderated by Dr. Lucie Duucarre\, and the panel discussants will be Associate Professor Kari Hagatun and Professor Jan Skrobanek.  \n\nAbout the speakers\n\nLucie Ducarre recently defended her PhD thesis titled\, “The Right to Education of Autistic Children in International and European Law\,” at the Faculty of Law (UiB). Dr. Ducarre has studied law and international relations in France and in the UK and holds a master’s in law with specialization in Children Rights. Before completing her PhD\, she worked as a legal consultant and writer. \n\nKari Hagatun is an Associate Professor at the Department of Education (UiB). DESCRIPTION:Bli med på Barnevernfrokost\, der Dr. Samuel Olaniyan diskuterer arbeidsmiljøet for barnevernsansatte.  \nNorsk barnevern er stadig under press både nasjonalt og internasjonalt etter flere ugunstige dommer i den Europeiske menneskerettighetsdomstolen (EMD) og nasjonale tilsyn som avdekket alvorlige problemer i systemet. Disse utfordringene deles også av flertallet av barnevernet i de vestlige samfunn. Selv om den utfordrende situasjonen for barnevernsansatte har fått mer fokus de siste årene\, er det begrenset kunnskap om hvordan barnevernsledere opplever sin arbeidssituasjon\, og hvilken rolle dette kan spille i arbeidsmiljøet. Funn fra lederlitteratur viser at lederen er en nøkkelfigur når man diskuterer ansattes prestasjoner og trivsel. Dette er enda større grunn til å sette søkelys på å hjelpe disse lederne med å møte sine daglige utfordringer.  \nDr. Samuel Olaniyan er i dag førsteamanuensis i psykologi ved Høgskolen i Innlandet. Han forsker hovedsakelig på arbeidsmiljø og ledelse. Han har publisert flere artikler om arbeidsmiljø blant ansatte i barnevernet. \n_________________________________________________________________________________ \nJoin us at Barnevernfrokost where Dr. Samuel Olaniyan will discuss the working environment for childcare workers. \nNorwegian child protection is constantly under pressure both nationally and internationally following several unfavorable judgments in the European Court of Human Rights (ECtHR) and national inspections that revealed serious problems in the system. These challenges are also shared by the majority of child welfare workers in Western societies. Although the challenging situation for child welfare employees has received more focus in recent years\, there is limited knowledge about how child welfare managers experience their working situation\, and what role this may play in the working environment. Findings from management literature show that the manager is a key figure when discussing employee performance and well-being. This is even more reason to focus on helping these leaders meet their daily challenges. \nDr. Samuel Olaniyan is currently an associate professor in psychology at Høgskolen i Innlandet. He primarily researches the working environment and management. SUMMARY:RDV: Lost in Implementation: Lawless Intimacy & Legal Inconsistencies in Malaysian Islamic Law
DESCRIPTION:In Muslim-majority Malaysia\, an extensive Islamic bureaucracy exerts significant force in determining where and with whom Muslims can be intimate\, and what constitutes “halal” (lawful) intimacy. This is achieved through Islamic criminal laws that enable state surveillance and criminalization of extra- or pre-marital sexual intimacy\, and through Islamic family laws that govern the rules of marriage.   \n In this talk\, Nurul Huda Mohd. Razif\, a postdoctoral researcher at the University of Bergen\, will demonstrate that state attempts to gatekeep access to “halal” intimacy may not be as airtight as it seems due to legal ambiguities and loopholes in Islamic law. To illustrate this\,  Nurul will draw on two recent debates and developments in Islamic family law: the first concerns a scandalous union between a 41-year-old polygamous man with his (third) 11-year-old wife; and the second addresses the rising incidence of eloped polygamous marriages contracted across the border in Southern Thailand. These issues\, as the author suggests\, reveal inherent inconsistencies in Islamic family law that perpetuate unregulated marital practices such as child marriage and polygamy.  \nAbout the speaker \nNurul Huda Mohd. Razif is a social anthropologist and Marie Curie Postdoctoral Fellow at the University of Bergen. She studied Anthropology and French at the University of Western Australia and Sciences Po Paris\, before receiving her PhD in Social Anthropology from the University of Cambridge in 2018. She has held research fellowships at Harvard Law School and centers for Southeast Asian Studies in Leiden\, Paris\, and Kyoto. DESCRIPTION:In this seminar\, Jill Marshall examines how human rights law\, particularly the European Court of Human Rights\, has developed the right to personal identity under Article 8 of the European Convention on Human Rights. Building on previous work\, she focuses on the Court’s case law relating to children\, analyzing how personal identity is protected and interpreted. Barn føler seg imidlertid ofte ekskludert og ikke hørt. I denne presentasjonen utforsker Iselin Huseby Lie hvorfor barnevernsansatte har en tendens til å utelate barn fra diskusjoner om samvær. Hun vil fremheve hvordan vanlige syn på barn – som rettighetshavere\, sårbare og mentalt umodne – former disse avgjørelsene. However\, children often feel excluded and unheard. In this presentation\, Iselin Huseby Lie explores why social workers tend to leave children out of discussions about contact visits. She will highlight how common views of children—as rights holders\, vulnerable\, and mentally immature—shape these decisions. Lie will also suggest ways to expand the concept of conversations\, enabling social workers to better engage children.   \nIselin Huseby Lie is a doctoral candidate in social sciences at OsloMet with a background as a foster home consultant in the child welfare service. She researches\, among other things\, the participation of children placed in care\, visitation issues\, and her thesis has sought a broad approach to the topic. Her research includes children’s perspectives on visitation\, social workers’ attitudes on children’s participation\, limits to participation\, and social workers’ practice related to visitation issues. SUMMARY:RDV: Child welfare predictive risk models and legal decision making
DESCRIPTION:Child welfare agencies around the world have experimented with algorithmic predictive modeling as a method to assist in decision-making regarding foster child risk\, removal\, and placement. These models have attracted a great deal of controversy about the methods used to create them and the biases inherent in the data they have drawn from\, however\, proponents see them as a tool for improving decision-making and ultimately the safety of children at risk. Thus far\, all of the predictive models have been confined to the employees of the various child welfare agencies at the early removal stages and none have been used by attorneys in legal arguments or by judges in approving or denying removal decisions. Predictive models are regularly used in other courtroom settings and have been studied for how they affect decision-making in general. This is the first study to examine the effects of a child welfare predictive risk model on child welfare attorney and judge legal decision-making. Using vignettes based on actual disputed removal cases with the inclusion of a low\, medium\, or high child welfare predictive risk score\, attorney and judge legal decision-making can be changed by the inclusion of a predictive model risk score in ways that are important for the legal community to understand prior to the widespread use of any of these models in the courtroom.  \nAbout the speaker \nMatthew Trail\, JD worked for fifteen years as an attorney ad litem representing children in foster care\, with a focus on representing children with disabilities and mental health issues from trauma. He began his career at a legal aid office in Florida and then moved to Houston where he eventually became managing attorney for Disability Rights Texas’ foster team. SUMMARY:Barnevernfrokost: TikTok Social Workers revolutionizing child protection
DESCRIPTION:Finnish social workers Maija Haapala and Camilla Jokela engage with the youth through TikTok\, translating the practicalities of child protection and social work\, and challenging official language into easily understandable TikTok videos. This innovative approach has brought national recognition\, making them known as a TikTok–Sossut (TikTok Social Workers). The goal of TikTok Social Workers is revolution in child protection\, meaning doing things differently\, being there in the social media where the young are and focusing on children’s rights and participation in their platform. Haapala and Jokela have been communicating on the social media platform TikTok for four years and have over 50k followers. In their presentation Haapala and Jokela are sharing their story how making TikToks started\, what is their goal and what kind of work have they done in TikTok\, aiming to courage all social workers to engage in social media and making child protection more understandable and less stigmatizing.  \nMaija Haapala is a licensed social worker with notable experience in child protection services. Her professional journey includes working as a social worker in child protection services at the City of Espoo. Currently\, she is working on her doctoral thesis at the University of Tampere concerning the emergency placements of young people and their impacts. Maija’s professional interest are in structural social work\, partnership with the children and the young and social impact in child protection.  \nCamilla Jokela is a licenced social worker and works full-time in the emergency social services of the wellbeing services county of Central Ostrobothnia (Soite). Jokela also works as a representative for children and young people who have come to Finland without a guardian. Camilla has worked with unaccompanied children in immigration services and child protection services. SUMMARY:RDV: Navigating institutional borders: young refugees’ access to post-15 education in Greece
DESCRIPTION:In this seminar\, Dr. Lucy Hunt addresses the social consequences of the refugee crisis in Greece\, and particularly how state responses to increased migration flows have shaped young refugees’ (aged 15–25) (re-)engagement with post-15 learning opportunities upon arrival in the country. It argues that three key ‘institutional bordering’ practices – namely\, the bordering of space (via encampment)\, time (via enforced waiting)\, and public services (via administrative barriers) – have played central roles in young refugees’ (re-)engagement with post-15 education; often causing their dreams to be diverted or downgraded. SUMMARY:RDV: Regulating Judges in a Modern Democracy: Insights from Canada
DESCRIPTION:In this RDV-seminar\, professor Richard Devlin and professor Sheila Wildeman\, both from the Schulich School of Law from the Dalhousie University\, Canada\, will present their co-authored paper that outlines eight general principles for democratically defensible complaints and discipline for judges. The paper also provides a critical analysis of the new 2023 legislative reforms to the judicial discipline process in Canada\, using the theoretical framework established in the books “Regulating Judges” and “Disciplining Judges”. The arguments in these books are relevant to any democratic society\, while the case study in the co-authored paper applies the theory to a particular jurisdiction. The seminar will be of interest to anyone interested in the intersection of law\, democracy\, and judicial accountability. \nAbout the speakers \nRichard Devlin is a renowned Canadian law professor at Dalhousie University. An esteemed figure in the fields of legal theory\, equality\, legal ethics\, and the regulation of the legal profession\, Devlin became a Fellow of the Royal Society of Canada in 2015. His scholarly pursuits include critiquing legal structures that impact equality\, particularly regarding access to justice\, economic factors affecting legal service delivery\, and various forms of legal inequality related to race\, gender\, and disability. Devlin has taught law for nearly three decades and served as the Acting Dean of the Schulich School of Law at Dalhousie University during 2020. \nSheila Wildeman is a Canadian legal scholar and professor at the Schulich School of Law at Dalhousie University. She holds a Bachelor of Arts degree from the University of Victoria\, a Bachelor of Laws degree from Dalhousie University\, and a Master of Laws degree from the University of British Columbia. Wildeman’s research focuses on issues related to health law\, disability rights\, and social justice. She has published extensively on topics such as the legal regulation of assisted reproduction\, the rights of persons with disabilities\, and the intersection of law and health policy. SUMMARY:RDV: Traveling across disciplinary boundaries:  A journey into applying literary criticism to public-facing texts by street-level bureaucrats
DESCRIPTION:Researchers in the social sciences\, including legal studies\, political science\, social work\, and sociology\, utilize specific\, discipline-based approaches to analyzing written texts\, including frequency counts of words and text segments and determining thematic patterns emerging from the data. This seminar\, with speakers Katrin Križ and Daniela Reimer and discussant Tarja Pösö\, aims to walk participants beyond the boundaries of these social science approaches by introducing the methods of literary criticism and reflecting on their methodological potential. What can social scientists learn from literary criticism methods for analyzing public-facing texts by street-level bureaucrats? “Public-facing texts” are documents by street-level bureaucrats like child protection caseworkers\, judges\, teachers\, and police officers written for members of the public as part of public policy implementation. Examples of these texts in child protection are court judgments or university course curricula for future child protection caseworkers. This seminar explores how literary criticism methods could be valuable for systematically examining and interpreting these texts.  \nFirst\, Križ and Reimer will discuss literary criticism methods before reflecting on how social scientists could apply them. Second\, they will use their research about child protection-related court judgments by the European Court of Human Rights as an example. Lastly\, Križ and Reimer invite seminar participants to reflect on how these methods might be useful in their own research when studying public-facing texts by street-level bureaucrats. Her research is focused on the role of professional discretion in decisions related to a child’s best interests and child welfare systems in an international context.  \nTogether with colleagues Frøydis Lønborg Haarberg\, Audun Gabriel Løvlie\, and Marit Skivenes at the University of Bergen\, Križ is working on the research project “Children’s Right to Participation”.  \nDaniela Reimer is a Professor at the Zurich University of Applied Sciences\, School of Social Work\, specializing in child and youth services\, family dynamics\, and foster care. Her research focuses on understanding the experiences of children in care\, particularly in transitions and identity formation.  \nReimer has conducted extensive studies on (foster) family cultures\, the interplay of normality and identity among young people in foster care\, and breakdowns within foster care systems. SUMMARY:RDV: Exploring the intersection of food and family intervention policies in England: how are children included?
DESCRIPTION:In England\, a rhetoric of supporting ‘troubled families’ through policy interventions mushroomed during the New Labour years of the late 1990s. At this time\, early years settings became sites of particular interest in which to implement these policies\, seen as places where perceived deficiencies in the household could be addressed. This has led to an overlap of policy domains\, predominantly between early years education and family intervention\, yet also expanding into other areas. In this context\, children’s food policy is seen as an especially fruitful area for intervention\, where the aim of ‘improving children’s diets’ often seems to be interlaced with a concern for ‘improving parenting styles’.  \nBased on ethnographic fieldwork carried out in London between 2016 and 2017\, this paper explores what happens at the intersection of these different policy domains\, examining how particular framings of policy problems – and the solutions developed to address these problems – lead to contradictions and arbitrary results. Linking to wider discussions about the current early childhood education and care (ECEC) landscape in England\, the paper also asks to what extent are children’s viewpoints and experiences considered when interventions are developed\, and what can be gained when doing so in a meaningful way.   \nAbout the speaker \nFrancesca Vaghi is a Research Associate at the School of Social & Political Science at the University of Glasgow\, Scotland. She is currently conducting research on the work of contemporary NHS charities as part of the Border Crossings project: https://more.bham.ac.uk/border-crossings/border-crossings/projects/ \nFrancesca is interested in medical anthropology\, the anthropology of policy\, and childhood studies. She completed her PhD in 2019 at SOAS\, University of London. For her doctoral research\, Francesca conducted ethnographic fieldwork in a state-maintained nursery in London over a 12-month period\, developing a child-centred methodological approach to meaningfully involve children in research. Aside from investigating how children create self and peer identities through food and eating practices\, her work explores how children’s food policy fits into family intervention policies in the context of Britain’s mixed economy of welfare\, and how notions of ‘good food’ and ‘good parenting’ (particularly mothering) are interlinked. SUMMARY:Barnevernfrokost: Foreldreoppfølging etter omsorgsovertakelse i familievernet – et supplement til barneverntjenestens oppfølgingsansvar
DESCRIPTION:Det er flere grunner til at foreldre bør følges opp etter en omsorgsovertakelse. Foreldre har ofte omfattende behov for hjelp\, og hjelpebehovene forsterkes ofte etter at barna blir plassert. I tillegg kan mange barn bekymre seg for hvordan foreldrene har det og som en følge av det ha vansker med å slå seg til ro med plasseringen. Foreldre som er fratatt omsorgen for egne barn\, har vært fokusert lite på i hjelpeapparatet. Mange foreldre beskriver tett oppfølging frem til omsorgsovertagelsen\, men at de i etterkant står igjen alene fordi hjelpen følger barnet. I tillegg opplever mange at samarbeidet mellom barnevern og foreldre er svært utfordrende\, da det blir vanskelig å ta imot hjelp fra den samme instansen som initierte omsorgovertakelsen. \nSom et supplement til barneverntjenestens oppfølging\, fikk familievernet i 2015 i oppdrag å tilby foreldreoppfølging etter omsorgsovertagelse. Det ble etablert et eget Spisskompetansemiljø som arbeider med å sikre kunnskapsgrunnlag\, fagutvikling og implementering av kunnskapsbasert og likeverdig tilbud ved alle landets familievernkontor.  Målsetningen med tilbudet er å hjelpe foreldre å mestre livene sine etter en omsorgsovertagelse\, bearbeide vanskelige følelser og tilpasse seg en ny rolle som samværsforeldre. Foreldre som har benyttet seg av familievernets tilbud sier de er godt fornøyde med den hjelpen de har mottatt. Til tross for et uttrykt behov et slik tilbud\, er det få som benytter seg av familievernets oppfølging. Questions related to gender identity and homosexuality are central to public discourse and political mobilisation. They are instrumental for illiberal and autocratic politicians’ rise to and hold of power. \nWhat drives and shapes these trends? What are their effects? \nSatang Nabaneh will discuss the characteristics of the gendered autocratisation dynamics and counter-forces on the African continent\, focusing on the underlying question about how is gender used by populist politicians and autocratic leaders in Africa? \n\nThe lecture is free and open to all. \nAbout the speaker \nSatang Nabaneh is the Director of Programs at the Human Rights Center at the \, where she is also a Research Professor of Law. SUMMARY:RDV: Child Protection Case Law from Constitutional Courts: A Comparative Survey
DESCRIPTION:The right to protection from violence and exploitation is one of the most commonly-protected constitutional rights of children\, being second only to the right to education in the frequency with which it features in national constitutions. For the most part\, the legal framework for vindicating this right is set out at the level of ordinary legislation rather than in constitutional law; but some child protection cases find their way to constitutional courts. These include cases taken by national authorities against parents who are exercising parental rights in a manner detrimental to children; cases taken against national authorities for failing to adequately protect children from violence\, or to protect the rights of child victims in the justice system; and cases where the constitutionality of child protection laws (eg on corporal punishment) is challenged. This presentation will survey a selection of cases from around the world\, seeking to identify common themes and explore the added value of children’s constitutional rights in the arena of child protection. \nAbout the speaker \nConnor O’Mahony is a Professor at the University College Cork (Ireland). He is also the Director of the Child Law Clinic at the university\, through which he works to support litigation concerning children and to advocate for law reform in the area of child law. Professor O’Mahony’s research interests lie broadly in the areas of constitutional law and child law\, with a particular focus on family and children’s rights. SUMMARY:RDV: Effects of lawfare: Criminalization of abortion in Peru
DESCRIPTION:How does the criminalization of abortion impact women?\nTherapeutic abortion has been decriminalised in Peru since 1924\, but it was only in 2014 that a protocol was approved to guarantee access to the procedure. However\, in 100 years\, no additional grounds have been legalised\, resulting in thousands of women and pregnant people being prosecuted for the crime of abortion. In this seminar Carolina Neyra analyses the impact of criminalization of abortion and other obstetric events on the human rights of women and pregnant people in Peru.\nThe seminar is based on a national study which is part of a regional report on the criminalisation of women and pregnant people for the crime of abortion in seven countries in Latin America and the Caribbean.\n\nABOUT THE SPEAKER:\nCarolina Neyra is a lawyer who graduated with honours from the Universidad del Pacífico in Lima\, Peru. In 2019\, she completed an internship at the Merits Unit of the Inter-American Commission on Human Rights. She has also participated in research projects on the rights of LGTBIQ+ people in Peru\, as well as in the development of public policies focused on gender equality and the eradication of gender-based violence. DESCRIPTION:The Development of Personal Identity Rights at the European Court of Human Rights: whose rights and what is achieved?  \nBy reference to applied philosophy and case law\, Jill Marshall explores how human rights law\, and particularly the European Court of Human Rights (the Court)\, has developed and interpreted a right to personal identity\, largely arising from a right to respect for one’s private life – see J Marshall: Personal Freedom Through Human Rights Law? (2009); Human Rights Law and Personal Identity (2014) and Personal Identity and the European Court of Human Rights (2022). This paper continues Marshall’s analysis by reference to the Court’s case law\, concentrating on more recent cases. The paper interrogates the development of these rights analysing whose rights have been protected and what role human rights law plays in the formation\, and protection\, of permissible personal identities\, asking and suggesting some responses to what has been\, and could be\, achieved. Marshall’s analysis includes cases on Islamic headscarves\, secret births\, and intercultural adoption. \nShort Author Biography:  \nProfessor Jill Marshall\, Professor of Law\, Department of Law and Criminology\, Royal Holloway University of London co-directs the interdisciplinary Centre for the Study of Emotion and Law (CSEL). She also leads the Rights and Freedoms research cluster and postgraduate research within her department. She is a qualified lawyer. Her work focuses on the relationship between law and living well\, human flourishing\, what it means to be free\, with a focus on girls’ and women’s human rights. She has written widely on these topics and is the author of three books and one edited collection. SUMMARY:RDV: The cost of caring: the professional quality of life of child social workers
DESCRIPTION:The cost of caring: the professional quality of life of child social workers (Camille Verheyden\, Frank Van Holen\, Stephanie Chartier & Johan Vanderfaeillie) \nSeveral international studies show that child social workers are at increased risk of developing burnout and secondary traumatic stress. Causes are: working daily with vulnerable children and families\, confronting others’ traumas\, the many demands and challenges of the job and\, the high workload. In addition\, the sector is currently struggling with high dropout rates and staff turnover. This context forms a threat to the professional quality of life of child social workers resulting in negative consequences for the child social workers themselves\, the persons they accompany and the organisations where they are employed. To date\, there are few results available on the professional quality of life (burnout\, secondary traumatic stress\, compassion satisfaction) of child social workers in Europe and there are none for Belgium (Flanders and Wallonia) so far. To gain insight into this\, we investigated the professional quality of life of child social workers in Flanders and Wallonia. Camille Verheyden and Johan Vanderfaeillie will share their preliminary findings from their study. \nCamille Verheyden is a PhD-student at the Department Psychology\, Faculty of Psychology and Educational Sciences\, Vrije Universiteit Brussel. DESCRIPTION:Norge er inne i en fosterhjemskrise! Det er stor mangel på fosterhjem. Barn står i kø for å få et trygt hjem. Fosterhjemsomsorgen er grunnmuren i barneverntjenesten. 9 av 10 barn som av ulike grunner ikke kan bo hjemme med sine foreldre\, bor i fosterhjem. Alle parter ønsker at disse barna skal bo i fosterhjem\, framfor på institusjon\, men det er vanskelig å rekruttere mange nok godkjente fosterhjem. Det er et sammensatt bilde av hvorfor vi er kommet i denne situasjonen\, – at barn lever under omsorgssvikt og de ikke får rett hjelp til rett tid. SUMMARY:Courts as Champions of Women\, Children\, and Marginalised Groups by Brenda Hale
DESCRIPTION:On Friday\, October 27th\, former President of the Supreme Court of the United Kingdom\, Lady Brenda Hale\, Baroness Hale of Richmond will be the Department of Government’s esteemed speaker at the General Seminar in Politics and Government. \nLady Hale is a trailblazer in British law and achieved several historic milestones throughout her career. She notably became the first woman to serve as President of the Supreme Court of the United Kingdom\, a position she held from 2017 until her retirement in 2020. \nShe received her education at Richmond High School for Girls in North Yorkshire and Girton College\, Cambridge\, where she currently holds the position of Visitor. Lady Hale was called to the Bar by Gray’s Inn\, where she was Treasurer in 2017. For nearly two decades\, she taught Law at Manchester University for 18 years\, specialising in family and social welfare law\, and also practiced at the Manchester Bar for a period. \nIn 1984\, she made history as the first woman to join the Law Commission\, which promotes legal reform. Here she played an important role which led to the Children Act of 1989 and the Mental Capacity Act 2005. She was also a founder member of the Human Fertilisation and Embryology Authority and chair of its Code of Practice Committee from 1990 until 1994\, when she was appointed a Judge of the Family Division of the High Court. She was promoted to the Court of Appeal of England and Wales in 1999 and in 2004 became a ‘Lord of Appeal in Ordinary’ in the House of Lords. This was the top court for the whole United Kingdom\, until the ‘Law Lords’ became the Justices of the newly established Supreme Court of the United Kingdom in 2009. She became its Deputy President in 2013 and President in 2017. \nWhile at Manchester University she was joint founding editor of the Journal of Social Welfare and Family Law and authored a number of books\, including The Family\, Law and Society: Cases and Materials and Women and the Law. In 2004\, she helped to establish the United Kingdom Association of Women Judges and from 2010 to 2012 served as President of the International Association of Women Judges\, a world-wide body of both men and women judges committed to equality and human rights for all. A practising member of the Church of England\, she has always taken an interest in religion and the law\, and has written and spoken on the subject many times. \nThroughout her career\, Lady Hale’s impact has reached beyond national boundaries. Her principled stance and intellectual contributions have solidified her legacy as a pioneering figure in the legal community. Through a close connection to academia\, she has provided lectures on justice\, human rights and the legal system\, enriching the discourse in those critical areas. \nTopic of the General Seminar:  \nCourts as Champions of Women\, Children\, and Marginalised Groups \nBoth in legal theory and in practice\, courts are crucial for the protection of vulnerable groups and insular minorities. Most societies give special protection in law to certain groups\, such as children\, religious minorities\, and indigenous peoples\, while for others\, the legal protection is less clear\, for example when it comes to undocumented migrants and future (climate affected) generations. Minority protection are often perceived as threatening important societal interests (parental rights\, the natural family\, security\, economic growth\, green transformation) and increasingly place courts at the centre of heated political contestations. Diverging views between the European Court of Human Right and domestic courts on whose rights should prevail and what the State’s obligations are\, add complexity. How should courts navigate\, when the rights of vulnerable groups place the judiciary at risk of politicization?

SUMMARY:RDV: Abolition of child protection - The ultimate denial of child rights
DESCRIPTION:In the early 2000s the main narrative in the field of child welfare was an optimistic one. It was believed that families could become stronger if they received help in the form of economic and social support. Child welfare professionals could work together with parents in a respectful\, generous\, and culturally sensitive way. It was also believed that parents could change for the better if they were offered a restorative\, healing approach rather than a strict\, punitive response. This approach was meant to be more helpful and supportive to families. \nAlthough there are many who still share this view\, there is also a growing condemnation of child welfare. Some view\, everything about child welfare as wrong\, counter-productive – even a violation of human rights. What’s even more worrying is that the abolitionist viewpoint makes an important error trying to find simple solutions for a very complex issue\, namely\, how to keep kids safe and their families healthy and stable within the context of the flawed national history in the US related to poverty and race. Just as the child welfare field once relied too heavily on family separation\, the abolition school of thought would rid the US of its legally mandated obligation to child safety. \nThe child welfare system in the US has had decades of attempts toward reform\, however the reforms have not gone far enough\, nor have they had the widespread or deep effects that many of us want to see. Still\, if we are going to abandon the current child welfare system\, we must address some of the critical questions that have escaped the profession for decades and helped to drive the call for its end. \nJoin us for a thought-provoking seminar that delves into the pressing issues surrounding child welfare today! \nJill D. Berrick is a Distinguished Professor and the Zellerbach Family Foundation Professor of Social Welfare\, UC Berkeley\, and Professor II at the Department of Government\, University of Bergen. SUMMARY:RDV: Institutional Changes for Democratic Dialogue (Roberto Gargarella)
DESCRIPTION:We welcome you to our RDV seminar with Professor Roberto Gargarella. He will present the new project he is awarded by the European Research Council (ERC Advanced Grant): “Institutional Changes for Democratic Dialogue».
