SUMMARY:RDV: Effects of lawfare: Criminalization of abortion in Peru
DESCRIPTION:How does the criminalization of abortion impact women?\nTherapeutic abortion has been decriminalised in Peru since 1924\, but it was only in 2014 that a protocol was approved to guarantee access to the procedure. However\, in 100 years\, no additional grounds have been legalised\, resulting in thousands of women and pregnant people being prosecuted for the crime of abortion. In this seminar Carolina Neyra analyses the impact of criminalization of abortion and other obstetric events on the human rights of women and pregnant people in Peru.\nThe seminar is based on a national study which is part of a regional report on the criminalisation of women and pregnant people for the crime of abortion in seven countries in Latin America and the Caribbean.\n\nABOUT THE SPEAKER:\nCarolina Neyra is a lawyer who graduated with honours from the Universidad del Pacífico in Lima\, Peru. In 2019\, she completed an internship at the Merits Unit of the Inter-American Commission on Human Rights. She has also participated in research projects on the rights of LGTBIQ+ people in Peru\, as well as in the development of public policies focused on gender equality and the eradication of gender-based violence. SUMMARY:RDV: The Development of Personal Identity Rights at the European Court of Human Rights: whose rights and what is achieved?
DESCRIPTION:The Development of Personal Identity Rights at the European Court of Human Rights: whose rights and what is achieved?  \nBy reference to applied philosophy and case law\, Jill Marshall explores how human rights law\, and particularly the European Court of Human Rights (the Court)\, has developed and interpreted a right to personal identity\, largely arising from a right to respect for one’s private life – see J Marshall: Personal Freedom Through Human Rights Law? (2009); Human Rights Law and Personal Identity (2014) and Personal Identity and the European Court of Human Rights (2022). This paper continues Marshall’s analysis by reference to the Court’s case law\, concentrating on more recent cases. The paper interrogates the development of these rights analysing whose rights have been protected and what role human rights law plays in the formation\, and protection\, of permissible personal identities\, asking and suggesting some responses to what has been\, and could be\, achieved. Marshall’s analysis includes cases on Islamic headscarves\, secret births\, and intercultural adoption. \nShort Author Biography:  \nProfessor Jill Marshall\, Professor of Law\, Department of Law and Criminology\, Royal Holloway University of London co-directs the interdisciplinary Centre for the Study of Emotion and Law (CSEL). She also leads the Rights and Freedoms research cluster and postgraduate research within her department. She is a qualified lawyer. Her work focuses on the relationship between law and living well\, human flourishing\, what it means to be free\, with a focus on girls’ and women’s human rights. She has written widely on these topics and is the author of three books and one edited collection. SUMMARY:RDV: The cost of caring: the professional quality of life of child social workers
DESCRIPTION:The cost of caring: the professional quality of life of child social workers (Camille Verheyden\, Frank Van Holen\, Stephanie Chartier & Johan Vanderfaeillie) \nSeveral international studies show that child social workers are at increased risk of developing burnout and secondary traumatic stress. Causes are: working daily with vulnerable children and families\, confronting others’ traumas\, the many demands and challenges of the job and\, the high workload. In addition\, the sector is currently struggling with high dropout rates and staff turnover. This context forms a threat to the professional quality of life of child social workers resulting in negative consequences for the child social workers themselves\, the persons they accompany and the organisations where they are employed. To date\, there are few results available on the professional quality of life (burnout\, secondary traumatic stress\, compassion satisfaction) of child social workers in Europe and there are none for Belgium (Flanders and Wallonia) so far. To gain insight into this\, we investigated the professional quality of life of child social workers in Flanders and Wallonia. Camille Verheyden and Johan Vanderfaeillie will share their preliminary findings from their study. \nCamille Verheyden is a PhD-student at the Department Psychology\, Faculty of Psychology and Educational Sciences\, Vrije Universiteit Brussel. SUMMARY:RDV: Abolition of child protection - The ultimate denial of child rights
DESCRIPTION:In the early 2000s the main narrative in the field of child welfare was an optimistic one. It was believed that families could become stronger if they received help in the form of economic and social support. Child welfare professionals could work together with parents in a respectful\, generous\, and culturally sensitive way. It was also believed that parents could change for the better if they were offered a restorative\, healing approach rather than a strict\, punitive response. This approach was meant to be more helpful and supportive to families. \nAlthough there are many who still share this view\, there is also a growing condemnation of child welfare. Some view\, everything about child welfare as wrong\, counter-productive – even a violation of human rights. What’s even more worrying is that the abolitionist viewpoint makes an important error trying to find simple solutions for a very complex issue\, namely\, how to keep kids safe and their families healthy and stable within the context of the flawed national history in the US related to poverty and race. Just as the child welfare field once relied too heavily on family separation\, the abolition school of thought would rid the US of its legally mandated obligation to child safety. \nThe child welfare system in the US has had decades of attempts toward reform\, however the reforms have not gone far enough\, nor have they had the widespread or deep effects that many of us want to see. Still\, if we are going to abandon the current child welfare system\, we must address some of the critical questions that have escaped the profession for decades and helped to drive the call for its end. \nJoin us for a thought-provoking seminar that delves into the pressing issues surrounding child welfare today! \nJill D. Berrick is a Distinguished Professor and the Zellerbach Family Foundation Professor of Social Welfare\, UC Berkeley\, and Professor II at the Department of Government\, University of Bergen. Her research focuses on the child welfare system and efforts to improve the experiences of children and families touched by foster care. Her interests target the intersection of poverty\, childhood development\, parenting and the service systems designed to address family well-being. SUMMARY:RDV: Institutional Changes for Democratic Dialogue (Roberto Gargarella)
DESCRIPTION:We welcome you to our RDV seminar with Professor Roberto Gargarella. He will present the new project he is awarded by the European Research Council (ERC Advanced Grant): “Institutional Changes for Democratic Dialogue». SUMMARY:RDV: Child participation and child protection: lessons from international research (Aoife Daly)
DESCRIPTION:We welcome you to our RDV seminar with Professor Aoife Daly. She will give a talk on a paper which is based on her book “Children\, Autonomy and the Courts: Beyond the Right to be Heard“.  This paper is concerned with the influence of children on decisions affecting them. It appears that the right to be heard under Article 12 of the UN convention on the rights of the child has brought some positive change in terms of children simply feeling heard. It is not all about outcomes – the perception of being listened to\, of being taken seriously\, is undoubtedly good for children: I think the judge kind of listened to me in the end.  There is evidence that the right to be heard has encouraged an attitude shift when it comes to hearing children and valuing their views – there is a sense that children should be heard\, at least in some circumstances. Yet there is little point hearing children if their wishes are unlikely to make any difference to outcomes. Indeed Article 12 of the CRC says that children’s views must be given due weight\, which implies some level of influence. What does international research demonstrate in terms of the influence of children’s wishes and child protection proceedings in courts? This paper presents research in this area\, and findings point to inconsistent\, confusing and illogical approaches by the courts to children’s wishes. The reasons for this are considered in this paper. It is emphasised that courts refuse to accept that there is a limited ability to ensure a ‘good’ outcome. This is to the detriment of a good process\, one which prioritises children’s wishes. Courts also think that they are acting as benevolent parents when they impose best interest determinations\, which is mistaken as courts are representatives of the state (and therefore have the threat of force behind them). It is also mistaken because families do not always operate in a ‘parents say\, children do’ It is argued that there is a risk that the Article 12 right to be heard\, and its lack of influence for children in reality\, in fact works to uphold traditional power dynamics. The state wins because children’s wishes can be overridden when they incline against state authorities\, or prevailing beliefs such as ‘contact at all costs.’ It seems that children’s wishes within the ‘right to be heard’ framework are least effective where they are needed the most – where those wishes incline against adults\, and particularly where they incline against the status quo. The question of whether a focus on autonomy would shift this influence gap will be posed. \nAoife Daly teaches law\, and specialises in human rights law. Aoife’s research focuses on human rights based approaches and children’s rights in areas which include environmental rights\, climate activism\, and access to justice. She is at present researching children/youth and how their environmental activism is impacting human rights law. In 2023 she secured a European Research Council Consolidator Grant to build a team to carry out a large scale research study on child/youth climate justice-inside and outside the courts-around the world. SUMMARY:RDV: Analysis or paralysis? Monitory mechanisms for child protection services in Ireland (Kenneth Burns)
DESCRIPTION:Child protection and welfare systems are one essential part of a nation state’s approach to protecting and promoting the welfare of children. Keane (2022) argues that we are in a new phase of democracy called ‘monitory democracy’. In this phase\, democratic systems develop power scrutinising mechanisms and institutions that focus on public accountability and governance\, with this ‘monitoring’ work being undertaken by government institutions and civil society actors. As child protection and welfare systems are entrusted with significant power by governments\, they are a significant focus of such monitoring. \nThe focus of this paper is to examine the strategies and mechanisms adopted by Ireland to monitor the operation\, quality and development of its child protection and welfare system. DESCRIPTION:Child participation is one of the core principles of the United Nations Convention on the Rights of the Child (CRC). The Convention asserts that children and young people have the right to freely express their views and that there is an obligation to listen to children’s views and to facilitate their participation in all matters affecting them within their families\, schools\, public services\, institutions\, government policies and judicial procedures. Although the Convention on the Rights of the Child recently celebrated its 30th anniversary\, there is still a way to go on securing children’s right to participation. What does research tell us about what inhibits and promotes children’s participation? Dette er et sterkt statlig inngrep i familielivet i en særlig sårbar og usikker fase.  Likevel har vi liten systematisk kunnskap om disse alvorlige sakene. Ida Juhasz er sosiolog og stipendiat ved Universitetet i Bergen. I sitt doktorgradsprosjekt analyserer hun vedtak fra Fylkesnemnda etter Barnevernlovens §4-8/§4-12\, og utforsker beslutningsgrunnlaget og skjønnsrommet i saker om omsorgsovertakelser av nyfødte. Hvordan begrunnes og rettferdiggjøres vedtakene i slike komplekse og usikre barnevernssaker? Hvordan fatter man beslutninger som i stor grad er fremtidsvurderinger om barnets beste? SUMMARY:The Child’s Perspective in Court: Can we do better?
DESCRIPTION:The United Nations Convention on the Rights of the Child recently celebrated its 30th anniversary\, and although much has been achieved in the last three decades\, there is still work to do. Procedures affecting children are not as child-centric as they should be\, the child’s right to be heard is not taken seriously enough\, and the child’s perspective appears to be missing in much of the decision-making concerning children. \nThe European Court of Human Rights (ECtHR) frequently deals with cases directly impacting on the lives and rights of children\, without the children playing a direct and active role in the proceedings. Children\, it seems\, are incidental to a dispute between parents and the state concerning parental rights. Similarly\, discussions in the media are often framed in terms of parents vs. the state\, with the subject of the disagreement – the child – given little or no voice. \nChildren are not independently represented in these cases and thus the child’s perspective is too often left out. Especially very young children who cannot yet make full use of their right to be heard in matters concerning them\, are absent in decisions that will have significant consequences for their lives. \nHow can we succeed in including the child and her perspective more fully – both in the ECtHR and in national courts? How do we ensure that the child’s particular needs\, preferences and personality are emphasised and given due weight in the decision-making process \nAbout the Event\nWe are pleased to announce Nuala Mole from The AIRE Centre in London as our keynote speaker for this event. Nuala is one of Europe’s most prominent human rights lawyers\, and a leading actor within the field of human rights. Nuala will talk about her experience as part of the legal team in human and child rights cases before the ECtHR\, and will provide her professional insight into how children feature in these cases. The AIRE Centre (Advice on Individual Rights in Europe) has recently acted as intervening party in the case of Strand Lobben v Norway in the Grand Chamber of the ECtHR. \nThe keynote will be followed by a panel discussion and questions from the audience. DESCRIPTION:Den europeiske menneskerettighetsdomstolen slo nylig fast at Norge har krenket retten til familieliv i en sak om tvangsadopsjon av et barnevernsbarn. Flertallet i domstolens storkammer dømte i favør av den biologiske moren i den mye omtalte Lobben-saken. \nNærmere 30 norske barnevernssaker er tatt til behandling i menneskerettsdomstolen fra desember 2015 og fram til i dag. Dette er et langt høyere antall saker enn noe annet land. Samtidig rangeres Norge høyt på internasjonale indikatorer for barns rettigheter og velferd\, og det norske rettssystemet er ansett for å holde en høy standard når det kommer til rettssikkerhet. \nHva er årsaken til den internasjonale granskningen av det norske barnevernssystemet? DESCRIPTION:Date: Thursday 14th March\nTime:16:00-18:00\nPlace: Bergen Global\, Jekteviksbakken 31 \nIn recent years\, Europe has seen strong conservative mobilization against abortion\, LGBT-rights and child protection services. Through the Internet\, intensive lobbying and funding from abroad\, these movements are gaining new ground – is the seemingly well-established right of abortion under threat in Europe? What are the driving forces behind this mobilization and is there a conservative network driving the movements? \nIn this seminar we will screen the documentary “Abortion: Backlash in Europe” which focuses on the European pro-life movements and the methods and arguments that these groups use. The screening will be followed by a conversation between Neil Datta\, Barbara Ruiken and Siri Gloppen\, in which they explore the links between the networks driving anti-abortion\, anti-LGBT and anti-child protection service mobilization. \nThe event is free and open to all. Coffee and snacks will be served. Organized by Centre on Law and Social Tranformation. \n\nNeil Datta is the Secretary of the European Parliamentary Forum on Population and Development\, a network of parliamentarians from across Europe who are committed to protecting sexual and reproductive health and rights. He has nearly twenty years’ experience in the field of political involvement in population and development\, and has conducted in-depth research on anti-choice activity in Europe. He is part of the LawTransform based research project on Sexual and Reproductive Rights Lawfare: Global Battles.\nBarbara Ruiken is a scientific assistant at the Centre for Research on Discretion and Paternalism at the Department of Administration and Organisation Theory. She holds a master’s degree in Administration and Organisation Theory and works mainly on the projects Discretion and the Child’s Best Interest and The Acceptability of Child Protection Interventions.\nSiri Gloppen is the Director of LawTransform and professor of Comparative Politics (UiB). She heads the research projects (supported by the Norwegian Research Council) on Sexual and Reproductive Rights Lawfare: Global Battles; and Political Determinants of Sexual and Reproductive Health\, where the conservative networks and their influence in different parts of the world is part of the dynamics under study.\n\n

DESCRIPTION:Prof. Karl Harald Søvig and prof. Marit Skivenes will present on children’s rights and child protection at the launch of a new book by Geir Kjell Andersland. \nThe book lunch is open for everyone interested. Information from the Norwegian announcement by publisher Bodoni: \nGeir Kjell Andersland (f. 1948) er jurist og politiker med særlig interesse for barns rettigheter og menneskerettigheter. Han har blant annet arbeidet som advokat\, administrerendedirektør på Haukeland Universitetssykehus\, regiondirektør i Bufetat og er nå avtroppende fylkesnemndsleder. Andersland har forfattet en rekke fagartikler i antologier\, aviser\, fagtidsskrifter og var redaktør for\, og medforfatter i\, antologien De Castbergske barnelover 1915–2015 (2015). I 2017 utga Andersland Sviket mot barndommen. Om Gunnar Staalesen\, Varg Veum og barnevernet – sannhetsvitner og hjelpere for forsømte og sviktede barn. \nBokens forfatter runder 70 år 22. november i år. Dette har foranlediget den foreliggende samlingen av utvalgte artikler\, debattinnlegg og kronikker\, tidligere publisert i fagtidsskrifter og aviser gjennom de ti siste årene. I tillegg blir samlingens innledende og avsluttende artikkel\, samt to andre tekster\, publisert for første gang. Bokens viktigste budskap er kampen for å gi alle barn en god oppvekst og sikre dem deres grunnleggende rettigheter. For å oppnå dette kreves det kompetente fagfolk\, engasjerte\, handlingsrettede politikere og andre viktige medspillere\, det være seg kunstnere eller samfunnsborgere. Boken inneholder også de av forfatterens mange bokanmeldelser som sterkest berører bokens tre hovedtema: barns rettigheter\, barnevernets utfordringer og politikkens betydning.

SUMMARY:Breakfast forum: The Social and Political Challenges of Migration
DESCRIPTION:Migration is one of the major political issues in Europe today\, challenging the cohesion of the European Union and affecting national elections. How should Europe handle the increasing immigration?  \nWe are bringing together some of the world’s leading experts on the topic to provide a better understanding of the social and political consequences of migration to Europe. Mark Lopez from Pew Research Centre presents new results on European populations attitudes on immigration\, national identity and religion. Following the presentation\, Mark Lopez will be accompanied by Sagrario Segado\, Frøy Gudbrandsen and Christine Jacobsen in a panel discussion that will focus on the political and social consequences of migration to Europe. The panel will also address the complex and morally challenging question of how to deal with unaccompanied migrating minors. \nImmigration to Europe has increased over the last decades\, and became an urgent issue after the “refugee crisis” in 2015 and 2016\, when the number of Asylum seekers from predominantly Muslim countries multiplied. Nationalist and anti-immigrant attitudes have been prevalent in many recent national elections. European governments have struggled to handle the large number of refugees\, and to agree on an acceptable distribution of burdens between the different national states. Poland and Hungary flat out reject to contribute to EU´s migration plan. Italy has recently refused boats with refugees to dock\, and thus Spain is now the main port to Europe for the refugees. The political and social consequences of the influx of refugees\, is not yet known. \nHowever\, as war\, natural disasters\, famine and poverty are constant risks\, it is not likely that the challenge will vanish in the near future. This means that European countries must find better ways to handle the reception of new asylum seekers\, and to integrating immigrants into the society. \nPARTICIPANTS \n– Mark Lopez\, director of Global migration and demography research at Pew Research Center (USA). He is a renowned expert on global migration and demography research. \n– Sagrario Segado\, professor in psychology at UNED and director of European Research Center in Policies and Action on Minors and Migration (Spain). Segado has firsthand experience with the influx of migrants to Melilla\, a Spanish city at the tip of north Africa. \n– Frøy Gudbrandsen\, political editor in the newspaper Bergens Tidende. She holds a PhD in Comparative Politics on Scandinavian Immigration Policy. \n– Christine M.
