SUMMARY:RDV: Child Protection Case Law from Constitutional Courts: A Comparative Survey
DESCRIPTION:The right to protection from violence and exploitation is one of the most commonly-protected constitutional rights of children\, being second only to the right to education in the frequency with which it features in national constitutions. For the most part\, the legal framework for vindicating this right is set out at the level of ordinary legislation rather than in constitutional law; but some child protection cases find their way to constitutional courts. These include cases taken by national authorities against parents who are exercising parental rights in a manner detrimental to children; cases taken against national authorities for failing to adequately protect children from violence\, or to protect the rights of child victims in the justice system; and cases where the constitutionality of child protection laws (eg on corporal punishment) is challenged. This presentation will survey a selection of cases from around the world\, seeking to identify common themes and explore the added value of children’s constitutional rights in the arena of child protection. \nAbout the speaker \nConnor O’Mahony is a Professor at the University College Cork (Ireland). He is also the Director of the Child Law Clinic at the university\, through which he works to support litigation concerning children and to advocate for law reform in the area of child law. Professor O’Mahony’s research interests lie broadly in the areas of constitutional law and child law\, with a particular focus on family and children’s rights. DESCRIPTION:Child Welfare Judgments and Decision Processes in Context\nGuest lecture by prof. Rami Benbenishty (Social Work / Social Welfare)\, University of Jerusalem / Bar Ilan University. The lecture is open for everyone interested. \nTopic: This presentation will focus on the Judgments and Decision Processes in Context (JUDPiC) model\, as it applies to judgments and decisions in cases of alleged child maltreatment. This model presents how case characteristics are processed by professionals embedded in social agencies who are influenced by their personal characteristics\, their agency features\, and the wider local and national context of the child welfare system. The implications for understanding and improving decisions are discussed. \nRami Benbenishty is Professor at the University of Jerusalem / Bar Ilan University.  His research mainly focus on disadvantaged children and youth at risk\, and on methods for promoting their welfare and safety in the community\, in school\, and in foster care and boarding school frameworks. His research also deals with improving decision-making methods used by professionals and policy makers in matters concerning children who are victims of abuse in the family or community. SUMMARY:Guest lecture: Protecting unaccompanied migrant children in Europe
DESCRIPTION:Guest lecture by Dr Ingi Iusmen\, University of Southampton. The lecture is open for everyone interested. \nWhose Children? Protecting unaccompanied migrant children in Europe: a case of diffused responsibility? \nThe years 2015-2016 saw an unprecedented number of refugees arriving in the European Union. In 2016 nearly every one in four asylum applicants in the EU was a child. Despite this influx of child refugees\, the efficiency and adequacy of European and national responses to address the situation of this vulnerable group has been limited and questionable.  This presentation sets out to investigate the factors and reasons explaining the failure of EU and national policy interventions to protect unaccompanied migrant children (UAMs) during the recent refugee crisis.

DESCRIPTION:Reflections on Street Level Bureaucracy\n \nLINK TO RECORDING: https://youtu.be/plVzG0UQ8L0 \nMichael Lipsky is well known in the field of public administration for his classic book about street-level bureaucracy (1980). Here\, he claim that state employees (such as police\, social workers and legal-aid lawyers) should be seen as part of the policy-making community and as exercisers of political power\, as they wield their considerable discretion in the day-to-day implementation of public programs. \nLipsky argues that these relatively low-level public service employees labor under huge caseloads\, ambiguous agency goals\, and inadequate resources. When combined with substantial discretionary authority and the requirement to interpret policy on a case-by-case basis\, the difference between government policy in theory and policy in practice can be substantial and troubling. \n\nRead more: Street-Level Bureaucracy\n\nIn this lecture\, Lipsky will draw on ideas and concerns he has with the way the field of  public administration is developing\, and share some of his newer thoughts and reflections on dimensions of street level bureaucracy. \nMichael Lipsky is a Distinguished Senior Fellow at Demos\, and a former professor of political science at MIT. \nThe lecture is open to the public. Om skjønn\, legitimitet og beslutninger i barnevernet.\n\n\n\n\n\n\n\n\nDet har stormet rundt norsk barnevern den siste tiden\, og barnevernets beslutninger har tidvis vært under massiv kritikk fra flere hold. Men hvorfor er det slik? Noen mener dette kan forklares ved at den sterke vektleggingen av barns rettigheter i Norge utfordrer kulturer og praksiser i mange samfunn. Andre mener barnevernet ikke har forståelse for andre kulturer og at inngrepene de gjør krenker retten til privatliv og familieliv. \nHege Beate Stein Helland er forsker ved forskningsprosjektet Adopsjon som barnevernstiltak og er tilknyttet Institutt for administrasjon og organisasjonsvitenskap og Centre for Research on Discretion and Paternalism som ledes av professor Marit Skivenes.  \nVed Centre for Research on Discretion and Paternalism forskes det på noen av de mest grunnleggende temaene i samfunnsvitenskapen\, der en studerer statens bruk av makt mot sine borgere\, og begrunnelsene til statlige inngrep i folks liv.  \n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\nForedraget starter kl. 10:15.
